These Terms and Conditions govern the use of the website, mobile application, and other services associated with radyora.app, together referred to as the “Service”. By accessing and using the Service, the user confirms that they have read, understood, and accepted these Terms. If you do not agree, you should not use the Service.

2. Geographic scope and international availability

The Service is initially intended for users in Portugal and Spain, but it may be made available and used by users in other countries. Radyora may include radio stations, podcasts, episodes, RSS feeds, and other audio content associated with different countries, regions, languages, and markets.

The user is responsible for ensuring that use of the Service in their country/region is permitted and complies with applicable law. We may limit or adapt features, content, advertising, access methods, languages, catalogues, and availability depending on the country/region, legal requirements, licences, third-party rights, or technical limitations.


3. Definitions

“Radyora”, “we”, “us” or “our” — the operator of the Service.

“User” or “you” — the person who accesses and uses the Service.

“Account” — user registration that allows access to additional features, such as favourites, history, preferences, and personalization.

“Content” — includes, without limitation, text, images, logos, trademarks, programming information, pages, design, graphic elements, metadata, editorial content, RSS feeds, descriptions, cover images, and other information made available through the Service.

“Audio Content” — includes, without limitation, radio streaming, live broadcasts, podcasts, episodes, replays, clips, excerpts, and other audio formats made available through the Service.

“Podcasts” — on-demand audio content, series, programmes, episodes, RSS feeds, cover images, descriptions, metadata, and other associated information.

“Third Parties” — entities external to the operator, including radio stations, broadcasters, podcasters, producers, publishers, podcast hosting platforms, advertising platforms, technology providers, streaming providers, and other partners.


4. Purpose of the Service

The Service allows, among other current or future features:

Access to online radio and the related user experience, including streaming playback.

Discovery, organization, and consultation of radio stations, podcasts, episodes, categories, regions, countries, languages, feeds, and associated content.

Creation of an account and management of preferences.

Favourite functionality, allowing users to save radio stations, podcasts, episodes, and/or other Audio Content.

Access to podcasts and other on-demand Audio Content, when made available.

Display of editorial, technical, and descriptive information about radio stations, podcasts, episodes, and other audio content.

Display of advertising and measurement/statistics, under the terms of the Privacy Policy and Cookie Policy.

The Service may evolve over time, and features may be added, changed, or removed.


5. Eligibility and use by minors

The Service is intended for users aged 16 or older, or another minimum age legally required in the user’s country/region for consent and use of digital services. If the user is a minor, they must have authorization and supervision from their legal representative. We may limit or block access where there are signs of improper use by minors.


6. User account


6.1. Account creation

Access to certain features may require creating an account. The user agrees to provide truthful, current, and complete information and to keep it updated.


6.2. Account security

The user is responsible for maintaining the confidentiality of their credentials, including password, and for all activity carried out through their account. You must notify us immediately if you suspect unauthorized use.


6.3. Suspension and cancellation

We may suspend or terminate accounts in case of violation of these Terms, for security reasons, fraud or abuse prevention, legal requirements, or to protect the Service, users, and third parties. The user may request account deletion as indicated in the Privacy Policy.


7. Favourites, history, and personalization

The favourites feature allows users to save radio stations, podcasts, episodes, and other Audio Content for quick access. The Service may also display recently played radio stations, consulted podcasts, played episodes, related suggestions, and other forms of personalization.

The Service may impose technical limits, such as request limits, anti-abuse mechanisms, and validations, to ensure stability and prevent improper manipulation. The user acknowledges that favourites, history, preferences, and saved content may be affected by content removals or changes, licensing changes, technical updates, unavailability of streams, feeds, or episodes, rights holder requests, or account termination, without prejudice to reasonable measures to preserve the experience where possible.


8. Audio content, streams, podcasts, feeds, and availability


8.1. Nature of the Service

Radyora operates as a platform for discovering, organizing, and accessing online radio stations, public streams, podcasts, episodes, RSS feeds, and other Audio Content. Unless expressly stated otherwise, Radyora is not the broadcaster, producer, publisher, or rights holder of Audio Content made available by radio stations, broadcasters, podcasters, producers, streaming platforms, podcast hosting platforms, technical providers, or other third parties.


8.2. Streaming, playback, and quality

Streaming and on-demand playback depend on external technical factors, including the user’s network, device, stream availability, feed availability, broadcaster infrastructure, podcast hosting platforms, streaming providers, and other third-party services. Interruptions, delays, quality variations, buffering, temporary unavailability, loading failures, or removal of streams, feeds, or episodes may occur.


8.3. Third-party control of streams, podcasts, and feeds

Radio streams, podcasts, episodes, RSS feeds, and other third-party Audio Content remain under the control of their respective rights holders, broadcasters, podcasters, producers, hosting platforms, or technical providers. Radyora does not control the programming, broadcast, advertising, interruptions, changes, editorial content, technical availability, feed updates, episode publication, or content removals carried out by third parties.


8.4. Podcasts and on-demand content

When made available, podcasts and other on-demand Audio Content may be subject to limited-time availability, geographic restrictions, editorial changes, removals, substitutions, licensing requirements, RSS feed changes, technical limitations, or other conditions defined by their respective rights holders, platforms, or providers.


8.5. No guarantee of continuous availability

We make reasonable efforts to keep the Service available and updated, but we do not guarantee uninterrupted operation, error-free use, or compatibility with all devices, operating systems, browsers, or network conditions. Radyora may remove, suspend, replace, or update radio stations, streams, podcasts, episodes, feeds, metadata, images, descriptions, or other Content when necessary for technical, legal, editorial, rights-related, quality, security, or availability reasons.


9. User conduct and acceptable use

By using the Service, the user agrees to:

Use the Service lawfully and in accordance with these Terms.

Not attempt to access restricted areas, bypass security measures, interfere with the operation of the Service, or compromise the experience of other users.

Not use the Service for fraudulent, abusive, defamatory, unlawful purposes, or in a way that violates third-party rights.

Not introduce malware, malicious scripts, vulnerability exploitation attempts, abusive scraping, or actions that harm the availability, integrity, or security of the Service.

Not use the Service to systematically extract, copy, republish, or redistribute streams, RSS feeds, episodes, metadata, images, logos, descriptions, databases, or other Content.

Not use the Service to download, record, redistribute, republish, or publicly make available third-party audio content without authorization.

We may adopt technical and operational measures to detect and mitigate abusive use, including temporary blocks, request limitations, account suspension, and other proportionate measures.


10. Content, copyright, trademarks, and intellectual property


10.1. Service content

Unless otherwise indicated, the software, design, databases, layout, interface, structure, features, own trademarks, own logos, own texts, and other elements developed by Radyora are owned by or licensed to the operator and are protected by intellectual property rights.


10.2. Third-party content, names, logos, podcasts, and trademarks

The Service may display names, logos, images, descriptions, categories, regions, metadata, streams, podcasts, episodes, RSS feeds, programming information, or other elements associated with radio stations, broadcasters, podcasters, producers, publishers, platforms, technical providers, and other third parties. These elements belong to their respective rights holders. Radyora does not claim ownership over third-party trademarks, logos, trade names, broadcasts, streams, podcasts, episodes, feeds, programming, or other third-party content.


10.3. Use for identification and discovery

When Radyora displays names, logos, images, descriptions, categories, regions, feeds, episodes, or other metadata of radio stations, podcasts, or third parties, it does so for the purpose of identifying, organizing, and facilitating discovery of the respective stations, programmes, podcasts, episodes, broadcasts, or Audio Content by users. Such use does not imply affiliation, sponsorship, approval, partnership, or official representation, unless expressly stated.


10.4. Public streams, feeds, and third-party content

Radyora may allow access to radio streams, podcasts, episodes, RSS feeds, or other Audio Content made publicly available online or technically accessible through the respective rights holders, broadcasters, podcasters, hosting platforms, or technical providers. Radyora does not host, record, download, modify, or claim ownership of such third-party Audio Content, unless expressly stated otherwise.


10.5. Licence to use the Service

We grant the user a limited, non-exclusive, non-transferable, and revocable licence to access and use the Service for personal and non-commercial purposes, in accordance with these Terms.


10.6. Restrictions

Reproduction, distribution, modification, reverse engineering, systematic data extraction, abusive scraping, unauthorized public availability, resale, unauthorized commercial exploitation, or any other unauthorized use of the Content or the Service is prohibited, except where permitted by law or with express authorization from the respective rights holders.


11. Requests from rights holders, radio stations, podcasters, and broadcasters


11.1. Right to contact by rights holders

If you represent a radio station, broadcaster, podcast, podcaster, producer, publisher, rights holder, trademark owner, streaming provider, podcast hosting provider, or other entity related to Content, Audio Content, logos, names, images, descriptions, metadata, feeds, episodes, or streams displayed on Radyora, you may contact us to request review, correction, update, attribution, replacement, or removal.


11.2. Types of requests accepted

Rights holders or authorized representatives may request, among other things:

Correction of a name, logo, image, description, category, region, or other metadata.

Update of a stream URL, RSS feed, official website, or technical information.

Update or replacement of a cover image, logo, or visual identity.

Change of attribution, authorship, ownership, or identification of a radio station, podcast, or episode.

Removal of a radio station, stream, podcast, episode, RSS feed, image, logo, description, metadata, or other associated Content.

Notification of alleged infringement of copyright, trademark, related rights, personality rights, or other rights.


11.3. How to submit a request

Requests must be sent to [email protected] and should include, where possible:

Name of the rights holder or representative entity.

Name and role of the contact person.

Professional email address or other verifiable contact.

Identification of the radio station, podcast, episode, feed, trademark, stream, logo, image, description, page, or Content concerned.

Clear description of the request: correction, update, attribution, replacement, or removal.

Reasonable proof of ownership, representation, or authorization to act on behalf of the entity.


11.4. Review and response

We will review requests received in good faith and seek to respond within a reasonable time. Where a request is valid, or where there are reasonable doubts regarding rights, licences, ownership, authorization, authorship, or use of third-party Content, we may remove, suspend, hide, replace, or modify the Content concerned, in whole or in part, without prior notice to users.


11.5. Removal without admission of infringement

The removal, suspension, modification, or replacement of any radio station, stream, podcast, episode, feed, logo, image, description, metadata, or third-party Content does not constitute an admission of infringement, liability, or wrongdoing by Radyora. Such measures may be taken to protect rights holders, users, third parties, and the platform itself.


11.6. Cooperation with rights holders

Radyora aims to maintain accurate, up-to-date information that respects third-party rights. Whenever a radio station, broadcaster, podcaster, producer, publisher, or rights holder wishes to update its presence on the platform, they may contact us to provide official information, updated logos, cover images, correct streams, RSS feeds, categories, region, description, authorship identification, display preferences, or removal preferences.


12. Advertising

The Service may display advertising, including advertising provided by third parties, for example Google AdSense, AdMob, or other advertising providers. The relevance and personalization of ads may depend on the user’s cookie preferences, consent, device settings, and applicable law, according to the Cookie Policy and Privacy Policy. There may be limitations or differences in advertising depending on the country/region, platform, or device.


13. Links to third parties

The Service may include links to third-party websites, services, streams, RSS feeds, podcast platforms, official pages, technical providers, or content. We do not control these services and are not responsible for their practices, terms, policies, availability, security, or content. Users are advised to consult the terms and policies of those third parties.


14. Liability and limitations


14.1. Use at your own risk

The Service is provided “as is” and “as available”. The user uses the Service at their own risk.


14.2. Limitation of liability

To the fullest extent permitted by law, we shall not be liable for indirect, incidental, consequential damages, loss of profits, loss of data, or losses resulting from the use or inability to use the Service, including technical failures, unavailability, streaming interruptions, geographic restrictions, cyberattacks, acts of third parties, changes, removals, or unavailability of content for legal, technical, editorial, operational, or licensing reasons.


14.3. Third-party liability

We are not responsible for Audio Content, streams, podcasts, episodes, RSS feeds, programming information, advertising, products, services, websites, information, logos, trademarks, or materials provided, controlled, or made available by third parties, including radio stations, broadcasters, podcasters, producers, streaming platforms, podcast hosting platforms, technical providers, advertising networks, or other external partners.

Radyora may display third-party information for identification, organization, discovery, and access purposes, but does not guarantee that such information is always complete, updated, accurate, or available. Rights holders may request corrections, updates, or removals under these Terms.

Nothing in these Terms excludes or limits liability that cannot be excluded by law, including in cases of intentional misconduct or gross negligence, where applicable.


15. Privacy and cookies

The processing of personal data is governed by the Privacy Policy. The use of cookies, identifiers, local storage, SDKs, and similar technologies is governed by the Cookie Policy, including consent and preference management mechanisms, where applicable.


16. Changes to these Terms

We may update these Terms at any time. The version in force will be available on the Service with the update date. Where there are relevant changes, we may communicate them through the Service or by other appropriate means. Continued use after changes means acceptance of the updated Terms.


17. Termination, suspension, or modification of the Service

We may discontinue, suspend, limit, or change all or part of the Service, temporarily or permanently, for technical, legal, commercial, licensing, security, quality, third-party rights, or operational reasons. Where reasonable, we will seek to communicate this in advance, without prejudice to the possibility of immediate action where necessary to comply with the law, protect rights, respond to rights holder requests, or preserve the security and integrity of the Service.


18. Governing law and jurisdiction

These Terms are governed by Portuguese law. Without prejudice to mandatory rules applicable in the consumer’s country of residence, where applicable, including Portugal, Spain, or any other country/region where the Service is available, in the event of a dispute the parties will seek to resolve it in good faith. Failing agreement, the competent court shall be the court of the consumer’s place of residence, where applicable, or another court competent under applicable law.
