These Terms and Conditions govern the use of the radyora.app website and/or application (the “Service”). By accessing and using the Service, the user declares that they have read, understood, and accepted these Terms. If you do not agree, you must not use the Service.

2. Geographical scope and international availability
The Service is initially intended for users in Portugal, but it may also be made available to and used by users in other countries. The user is responsible for ensuring that use of the Service in their country/region is permitted and complies with applicable law. We may limit or adapt features, content, advertising, access methods, and availability depending on the country/region, legal requirements, licences, or technical limitations.
3. Definitions
“Radyora” or “we” means the operator of the Service.
“User” or “you” means the person who accesses and uses the Service.
“Account” means a user registration that allows access to additional features, such as favourites.
“Content” includes, without limitation, text, images, logos, trademarks, programming, pages, design, graphic elements, metadata, editorial content, and other information made available through the Service.
“Audio Content” includes, without limitation, streaming radio, live broadcasts, podcasts, episodes, replays, clips, and other audio formats made available through the Service.
“Third Parties” means entities external to the operator, including radio stations, advertising platforms, technology providers, and other partners.
4. Purpose of the Service
The Service allows, among other current or future features:
Access to online radio and the related user experience, including playback (streaming).
Account creation and preference management.
Favourites functionality (saving radio stations and/or other Audio Content).
Availability of podcasts and other on-demand Audio Content (where provided).
Display of advertising and measurement/analytics, in accordance with the Privacy Policy and Cookie Policy.
The Service may evolve over time, and features may be added, changed, or removed.
5. Eligibility and use by minors
The Service is intended for users aged 16 or over, or such other minimum age as may be legally required in the user’s country/region for consent and use of digital services. If the user is a minor, they must have the authorisation and supervision of their legal representative. We may limit or block access where there are signs of improper use by minors.
6. User account
6.1. Account creation
To access certain features, it may be necessary to create an account. The user undertakes to provide true, current, and complete information and to keep it updated.
6.2. Account security
The user is responsible for maintaining the confidentiality of their credentials, including password, and for all activity carried out on their account. You must notify us immediately if you suspect any unauthorised use.
6.3. Suspension and termination
We may suspend or terminate accounts in the event of a breach of these Terms, for security reasons, fraud/abuse prevention, legal requirements, or to protect the Service and third parties. The user may request deletion of the account, under the terms set out in the Privacy Policy.
7. Favourites and personalisation
The favourites feature allows users to save radio stations and, in the future, podcasts and other Audio Content for quick access. The Service may impose technical limits, such as request limits, anti-abuse mechanisms, and validation procedures, to ensure stability and prevent improper manipulation. The user acknowledges that favourites may be affected by content removals/changes, licensing changes, technical updates, or account closure, without prejudice to reasonable measures to preserve the experience where possible.
8. Audio content, podcasts, and availability
8.1. Streaming and quality
Streaming playback depends on technical factors such as network, device, providers, and stream availability. Interruptions, delays, quality variations, buffering, or temporary unavailability may occur.
8.2. Podcasts and on-demand content
Where provided, podcasts and other on-demand Audio Content may be subject to:
Limited-time availability, for example licensing windows.
Geographical restrictions (geo-restriction), where required by licences or rights.
Changes, removals, or replacements for legal, editorial, or technical reasons.
8.3. No guarantee of continuous availability
We make reasonable efforts to keep the Service available, but we do not guarantee uninterrupted operation, error-free performance, or compatibility with all devices and browsers.
9. Rules of use and user conduct
When using the Service, the user agrees to:
Use the Service lawfully and in accordance with these Terms.
Not attempt to access restricted areas, bypass security measures, interfere with the operation of the Service, or compromise the experience of other users.
Not use the Service for fraudulent, abusive, defamatory, unlawful purposes, or in any way that infringes third-party rights.
Not introduce malware, malicious scripts, attempts to exploit vulnerabilities, abusive scraping, or actions that harm the availability of the Service.
We may adopt technical and operational measures to detect and mitigate abusive use, including temporary blocks, rate limiting, account suspension, and other proportionate measures.
10. Content, copyright, and intellectual property
10.1. Service content
Unless otherwise stated, the software, design, databases, layout, trademarks, logos, and other elements of the Service are owned by the operator or licensed to the operator and are protected by intellectual property rights.
10.2. Third-party content and trademarks
The Service may display references, logos, names, streams, and/or content associated with radio stations, podcasts, and other third parties. Such elements belong to their respective owners. Radyora does not claim ownership over third-party trademarks or content.
10.3. Licence to use
We grant the user a limited, non-exclusive, non-transferable, and revocable licence to access and use the Service for personal and non-commercial purposes, in accordance with these Terms.
10.4. Restrictions
The reproduction, distribution, modification, reverse engineering, systematic data extraction, unauthorised public making available, or any other unauthorised use of this Content or of the Service is prohibited, except where permitted by law and with express authorisation.
11. Advertising
The Service may display advertising, including advertising provided by third parties, for example Google AdSense. The relevance and personalisation of advertisements may depend on the user’s cookie preferences and consent, in accordance with the Cookie Policy and Privacy Policy. There may be limitations or differences in advertising depending on the country/region.
12. Third-party links
The Service may include links to third-party websites, services, or content. We do not control those services and are not responsible for their practices, terms, or policies. Users are advised to consult the terms and policies of those third parties.
13. Liability and limitations
13.1. Use at your own risk
The Service is provided “as is” and “as available”. The user uses the Service at their own risk.
13.2. Limitation of liability
To the fullest extent permitted by law, we shall not be liable for indirect, incidental, consequential damages, loss of profits, loss of data, or losses resulting from the use of, or inability to use, the Service, namely due to technical failures, unavailability, streaming interruptions, geographical restrictions, cyberattacks, acts of third parties, or changes/removals of content for legal or licensing reasons.
13.3. Third-party liability
We are not responsible for Audio Content, streams, podcasts, advertising, products, or services provided by third parties, nor for decisions made on the basis of information obtained through the Service.
Nothing in these Terms excludes or limits liability that cannot be excluded by law, for example in cases of wilful misconduct or gross negligence, where applicable.
14. Privacy and cookies
The processing of personal data is governed by the Privacy Policy. The use of cookies and similar technologies is governed by the Cookie Policy, including the consent management mechanism (Complianz).
15. Changes to the Terms
We may update these Terms at any time. The current version will be available on the Service with the update date. Where there are material changes, we may notify users through the Service. Continued use after changes means acceptance of the updated Terms.
16. Termination of the Service
We may discontinue the Service in whole or in part, temporarily or permanently, for technical, legal, commercial, licensing, security, or operational reasons. Whenever reasonable, we will seek to provide prior notice.
17. Governing law and jurisdiction
These Terms are governed by Portuguese law. Without prejudice to any mandatory rules applicable in the consumer’s country of residence, where applicable, in the event of a dispute the parties shall seek to resolve it in good faith. Failing agreement, jurisdiction shall lie with the court of the consumer’s place of residence, where applicable, or such other competent court as provided by law.
